Terms of Service

The terms that govern your use of TraderIndicator. Please read them carefully before subscribing or using the tools.

Effective date: [Effective Date]

These Terms of Service ("Terms") are a legal agreement between you and [Company Legal Name] ("TraderIndicator", "we", "us" or "our") governing your access to and use of the TraderIndicator website, indicators, screener and related services (collectively, the "Service"). By creating an account, subscribing or otherwise using the Service, you agree to these Terms.

Draft for review. This is a template Terms of Service and not legal advice. Have it reviewed by a qualified lawyer, and replace every bracketed placeholder before publishing.

1.Acceptance of these terms

By accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms and by any policies referenced in them, including our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2.Description of the service

TraderIndicator provides analysis tools, including a suite of indicators and a screener that run on TradingView, along with related educational material. The Service surfaces potential trade setups based on documented logic. It is important that you understand what the Service is not:

  • The Service does not provide financial, investment, tax or trading advice.
  • The Service does not issue trade signals as recommendations, does not place trades, and does not manage funds or portfolios on your behalf.
  • The Service does not guarantee any result, return, profit or level of accuracy. Past performance and backtested results do not guarantee future results.

You are solely responsible for evaluating the information the Service provides and for any decisions you make. A TradingView account may be required to use certain features; your use of TradingView is subject to TradingView's own terms.

3.Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and legally able to enter into a binding contract to use the Service. You may not use the Service if doing so is prohibited by the laws of your jurisdiction or if you are barred from receiving the Service under applicable law. You are responsible for ensuring that your use of the Service complies with all laws that apply to you.

4.Accounts and security

To access most features you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. Accounts are for a single user and may not be shared, resold or transferred without our written consent.

5.Subscription and billing

The Service is offered on a subscription basis. Current plans are:

  • Monthly at $49 per month, billed monthly.
  • Annual at $399 per year, billed annually.

Subscriptions renew automatically at the end of each billing period at the then-current price, using your payment method on file, unless you cancel before the renewal date. Payments are processed by a third-party payment processor, and by subscribing you authorize us and the processor to charge the applicable fees plus any taxes.

Cancellation. You may cancel at any time from your account. When you cancel, your subscription stops renewing and you keep access until the end of the period you have already paid for. Except where required by law, fees already paid are non-refundable, and an annual plan runs to its paid end date rather than being prorated.

Price changes. We may change our prices. Any change to the recurring fee for an existing subscription will take effect no earlier than your next billing period, and we will give you reasonable notice. Continuing to use the Service after a price change takes effect constitutes acceptance of the new price.

6.Acceptable use

You agree not to, and not to permit anyone else to:

  • Copy, resell, sublicense, redistribute or share access to the Service, indicators or scripts outside your own account.
  • Reverse engineer, decompile or attempt to extract the underlying source or logic of the indicators, except to the extent this restriction is prohibited by law.
  • Circumvent access controls, usage limits or security measures, or access the Service through unauthorized automated means.
  • Use the Service to break the law, infringe others' rights, or transmit malware or harmful code.
  • Interfere with or disrupt the integrity or performance of the Service or the infrastructure it depends on, including TradingView.

We may suspend or terminate access for conduct that we reasonably believe violates these Terms or harms other users, us or third parties.

7.Intellectual property

The Service, including the indicators, screener, scripts, website, text, graphics, logos and educational content, is owned by [Company Legal Name] or its licensors and is protected by intellectual property laws. Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal trading analysis. No other rights are granted. Any feedback you provide may be used by us without obligation to you.

8.Disclaimers

No financial advice. The Service is provided for informational and educational purposes only. Nothing in the Service constitutes financial, investment, tax, legal or trading advice, or a recommendation to buy, sell or hold any instrument.

Trading risk. Trading and investing involve substantial risk, including the possible loss of all capital. Markets are uncertain and no tool can predict them. You are solely responsible for your own trading decisions and their outcomes.

No warranty. The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any signal, backtest or data will be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

9.Limitation of liability

To the maximum extent permitted by law, [Company Legal Name] and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, trading losses, revenue, data or goodwill, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

10.Indemnification

You agree to indemnify and hold harmless [Company Legal Name] and its officers, employees and agents from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

11.Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your license to use the Service ends. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will survive.

12.Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13.Governing law

These Terms and any dispute arising out of or related to them or the Service are governed by the laws of [Jurisdiction / Governing Law], without regard to its conflict-of-laws rules. The courts located in [Jurisdiction / Governing Law] will have exclusive jurisdiction, except where mandatory law provides otherwise.

14.Contact

Questions about these Terms can be sent to [CONTACT_EMAIL], or through our contact page.
